Rental contract conditions for yacht charter / training

Contract partner
The rental contract is concluded between the landlord and the tenant, if necessary through the agency. If an agency is involved, it will only act as an intermediary.
Payment, withdrawal,
1. Unless otherwise stated in the contract, the down payment of the rental fee in the specified amount is due within 5 days of the conclusion of the contract, the remainder four weeks before the start of the trip. Payment must be received within the specified deadlines. If the deposit is not paid within the specified period, the charter company reserves the right to cancel the booking.
2. In urgent cases, the lessor can withdraw from the contract within 4 days of the conclusion of the contract. In this case, the landlord undertakes to reimburse any amounts paid to the tenant immediately (if necessary via the agency).
3. If the charterer cannot commence the charter, he must notify this immediately. If the charter company succeeds in a replacement charter at the same conditions, the charterer will be reimbursed his payments less processing costs incurred in the amount of 10% of the charter price. The following power conditions apply:

If the charter is canceled up to 12 weeks before the start of the charter, 30% of the charter price
If the charter is canceled up to 4 weeks before the start of the charter, 70% of the charter price
If the charter is canceled less than 4 weeks before the start of the charter, 100% of the charter price

If the yacht is chartered out at a lower charter price, the difference is borne by the charterer.
4. The tenant is strongly advised to take out travel cancellation insurance. The landlord or the agency will be happy to send you information and documents from the relevant insurance companies.

Landlord's Obligations
1. The booked yacht will be handed over to the lessee clean, ready to sail, seaworthy and, if possible, fully fueled.
2. If the booked yacht cannot be handed over on the date agreed in the rental contract (eg due to average, unseaworthiness due to an accident during the pre-charter, etc.), the lessor can provide an equivalent replacement yacht. Any warranty claims are retained by the renter if the replacement yacht is defective.
3. The tenant can use the berth parking spaces and washrooms free of charge for the entire rental period.

The tenant assures and undertakes as follows:
1. to adhere to the principles of good seamanship.
2. To master the seamanship and to have sufficient experience in the management of a yacht or to provide a responsible skipper with these characteristics. If the lessee or his skipper is not in possession of the required driver's license or certificate of proficiency to drive the yacht in the agreed boat class, the lessor reserves the right to refuse to hand over the yacht while retaining the charter price or to appoint a skipper in the name and at the expense of the lessee deliver.
3. to observe the legal regulations of the host country and to register and de-register with the harbor master.
4. not to use the yacht for commercial purposes, not to take unfamiliar passengers with them, not to let or rent the yacht to third parties without the written consent of the lessor and not to transport any dangerous goods or substances.
5. to leave the respective sea area of the lessor only with the prior written consent of the lessor.
6. not to make any changes to the ship or the equipment.
7. To treat the yacht and equipment with care, to only enter the yacht with boat shoes or other suitable shoes, to obtain detailed information about the conditions of the sailing area before the start of the trip, such as B. about currents and changed water levels in strong winds, etc ..
8. With popular wind forces from 7 Bft. not to leave the protective harbor.
9. to return the yacht in a perfect, tidy, cleared and fully fueled condition - otherwise the refueling and clearing will be charged. We charge € 6.00 / engine hour for refueling without additional costs for the renter.
10. to notify the landlord immediately (by telephone or telegraph) in the event of damage, collisions and average or other extraordinary incidents. In the event of damage to the ship or to persons, to make a record and to ensure a counter-confirmation from the harbor master, doctor, etc.
11. In the event of an average or similar cases, to always have the yacht towed on its own line and not to make any agreements on towing or rescue costs.
12. To check the condition of the ship and the completeness of equipment and inventory on handover and return (checklist) and to confirm this with his signature.
13. Report complaints about the yacht to the yacht's base immediately and note them in the handover or return protocol. Complaints displayed later are excluded.
14. If applicable, to sign legally prescribed charter contracts or the rental company's own contract forms before handing over the yacht.

Repairs and engine and bilge monitoring
1. Repairs worth more than 100 € generally require the approval of the landlord. Exchanged parts must be kept in any case. Expenses for repairs which were necessary as a result of material wear will be reimbursed by the landlord upon presentation of the receipted invoice.
2. The oil level, the cooling water level and the bilges are to be checked daily, the leakage of the cooling water must be checked continuously by the tenant. Damages caused by the engine running dry are not insured under any circumstances and are at the expense of the renter. Likewise, the engine cannot be used on a lean angle under sails of more than 10 degrees, as the engine then does not receive any water or oil.

Conditions of participation for practical trips

The trip price must be paid no later than 4 weeks before the start of the trip, or in the case of direct debit it will be collected by the school 4 weeks before the start. When registering, 50% of the sum is to be paid. The participation is only confirmed by 45 ° Nord once the deposit has been paid. The cruise price does not include the following costs: examination fees, arrival and departure, meals, port fees, fuel and all other consumables. Each trip participant is responsible for arriving on time. It is recommended to take out travel cancellation insurance. Damage to the ship or the equipment that was caused by a participant, according to which he is liable under civil law, are only to be borne by him to the extent that it is not covered by the yacht's comprehensive insurance or liability insurance. myCharternow is entitled to withdraw from the trip. If the school withdraws, all cruise fees that have already been paid will be refunded. If an examination cannot be carried out for unforeseeable reasons (weather, war, strike, etc.), the school cannot be held liable. If a participant withdraws from the trip, he has to pay 30% of the trip sum up to two months before the start of the trip, 50% for one month and then 100% of the trip amount when the contract is canceled. Should the school find a replacement, a cancellation fee of 15% has to be paid. The school's liability is limited to three times the travel price, provided that damage to the participant is not caused intentionally or through gross negligence. I ride at my own risk. The school is not responsible for any physical or property damage caused by the student. Unless the damage was caused intentionally or through gross negligence by the school or the instructor.
